The Department of Homeland Security (DHS) has issued an interim final rule (IFR) authorizing U.S. Citizenship and Immigration Services (USCIS) to require electronic filing, or e-filing, for certain immigration forms.
Under the new rule, USCIS may require a form to be filed electronically once it has been available for online filing for at least 180 days. Before making e-filing mandatory for a particular form, USCIS will provide at least 60 days’ advance notice on its website.
Applicants and petitioners subject to the electronic filing requirement will need to use a USCIS online account. Forms may be completed directly online or submitted by uploading a PDF of the completed form along with supporting documentation.
The new initiative is intended to reduce USCIS’s reliance on the U.S. Department of the Treasury’s physical lockbox facilities and further expand the use of electronic fee payments. DHS anticipates that the transition will reduce administrative costs while improving efficiency across the federal government.
Electronic filing also offers significant operational and security benefits. Digital data can be received, stored, and accessed more efficiently than paper-based filings, helping USCIS strengthen fraud detection, improve identity management, and enhance national security screening. Faster access to information and expanded data-analysis capabilities may also help reduce filing errors, incomplete applications, and processing times.
While electronic filing is already available for many USCIS forms, the IFR provides a framework for making e-filing mandatory for additional forms in the future. Individuals who are unable to file electronically may request a waiver based on undue hardship, although USCIS will determine whether to grant such requests.
The Interim Final Rule became effective on August 11, 2026. DHS will accept public comments submitted on or before October 13, 2026.
