On March 20, 2026, the U.S. Citizenship and Immigration Services (USCIS) announced that they have received enough petitions to meet the H-2B statutory cap of 33,000 visas for the second half of fiscal year 2026.

March 10, 2026 marked the final receipt date for new cap-subject H-2B petitions requesting employment start dates between April 1 and October 1, 2026.

The USCIS will reject any cap-subject H-2B petitions received after March 10, 2026, that request an employment start dates within this period.

In addition to the 66,000 annual statutory cap, supplemental visas are also available. On January 30, 2026, the Department of Homeland Security, through U.S. Citizenship and Immigration Services, in coordination with the Department of Labor, announced a temporary final rule providing an additional 64,716 H-2B temporary nonagricultural worker visas for fiscal year 2026, supplementing the standard annual cap.
